Welcome to HeartCity! These Terms of Service ("Terms") govern your use of the HeartCity mobile application ("App"), provided by HeartCity LLC ("Company," "we," "us," "our") located at 516 Quartz Street, Redwood City, CA. By accessing or using the App, you agree to comply with these Terms. If you do not agree, please do not use the App.
1. Acceptance of Terms
By creating an account or using the App, you confirm that you are at least 13 years old and capable of entering into a binding agreement. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Account Creation
To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
3. Service Opportunities
HeartCity allows users to find service opportunities through a list or map view, volunteer for events, and earn points and verified service hours. All users are encouraged to participate in events, provide feedback, and engage with other users in a respectful manner. Please note that you may interact with fake profiles or AI-generated content for testing purposes.
4. Donations and Fees
Users may make payments through the App as donations to organizations hosting events. HeartCity LLC may take a fee from any payments made through the App. We may adjust this fee at any time, and you acknowledge that these fees help us keep HeartCity free for everyone to use. We will provide notice of any material changes to the fees through the App.
5. User Conduct
You agree not to engage in any of the following prohibited activities:
- Harassing, threatening, or intimidating other users.- Impersonating any person or entity.- Violating any applicable laws or regulations.- Interfering with or disrupting the App or servers or networks connected to the App.
6. Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the exclusive property of HeartCity LLC and are protected by applicable copyright, trademark, patent, and other intellectual property laws.
7. Data Usage and Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and share your personal information. By using the App, you consent to the collection and use of your information as outlined in our Privacy Policy.
8. Limitation of Liability
To the fullest extent permitted by law, HeartCity LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App or any service opportunities. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, even if we have been advised of the possibility of such damages.
9. Indemnification
You agree to indemnify, defend, and hold harmless HeartCity LLC and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your infringement of any intellectual property or other rights of any person or entity.
10. Dispute Resolution
Any disputes arising out of or related to these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on the App. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
12. Termination
We may terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
